GENERAL SALE CONDITIONS (GTC) – KBFOTOART

1. PURPOSE

These General Conditions of Sale (GTCs) govern the contractual relations between: Kamel Benddif, acting under the trade name and trade mark KBFotoartdomiciled in 3 Rue du Beauregard 95660 Champagne sur Oise , hereinafter referred to as « the Seller », and any natural or legal person making a purchase on the site https://kbfotoart.com/, hereinafter referred to as « the Customer ».

  • Status: Individual entrepreneur (SIRET being registered).

  • Make: KBFotoart is a registered trademark with INPI.

3. PRODUCTS

The Seller offers for sale physical products: printed photographs (drawings of art), books and framed works.

  • The essential characteristics (format, paper type, frame materials) are detailed on each product sheet.

  • The Customer is informed that color rendering may vary from screen to screen and may differ slightly from the final product received.

4. RATES AND PAYMENT

  • Price: Prices are shown in Euros (€) excluding delivery costs. In accordance with Article 293b of the CGI, VAT is not applicable.

  • Shipping costs: Shipping costs are specified before the order is validated.

  • Payment: Payment is due immediately upon order by [CB / PayPal ].

5. DELIVERY

  • Shipment: Orders are shipped to the address indicated by the Customer.

  • Risks: The transfer of the risk of loss or damage occurs when the Customer (or a third party designated by the Customer) takes physical possession of the product.

  • Verification: The Customer must check the condition of the package upon arrival. In case of apparent damage, the Customer must refuse the parcel or issue precise handwritten reservations on the carrier's delivery note.

6. RIGHT OF RETRACTATION

In accordance with Article L221-18 of the Consumer Code, the Customer has 14 days to exercise its right of withdrawal from receipt of its order.

  • Exception: In accordance with Article L221-28, the right of withdrawal does not apply to products made according to the specifications of the Customer or clearly customized. This includes custom-made photo prints (format or specific support) at the request of the Customer.

  • Return: Return costs are to the Customer. The product must be returned in its original condition and packaging.

7. LEGAL GUARANTEE

The Seller is liable for defects in the conformity of the property to the contract under the conditions of article L. 217-4 et seq. of the Consumer Code and for the hidden defects of the thing sold.the conditions laid down in Articles 1641 et seq. of the Civil Code.

 

8. INTELLECTUAL PROPERTY

All the elements of the site (photographs, texts, logos) KBFotoart) are and remain the exclusive intellectual property of the Seller. Any reproduction, exploitation or use, even partial, is strictly prohibited without prior written consent. The purchase of a physical product does not entail any transfer of copyright to the image.

9. LITIGES AND MEDIAATION

These Terms and Conditions are subject to French law. In case of complaint, the Customer must contact the Seller in writing at: contact@kbfotoart.com. À défaut de résolution amiable, le Client peut saisir gratuitement un médiateur de la consommation conformément aux articles L.611-1 et suivants du Code de la consommation.
